The regular monthly meeting of the Lower Arkansas Valley Water Conservancy District Board of Directors was held on Wednesday, January 11th at the district office in Rocky Ford.
Present at the meeting were John Singletary, Chairman; Jay Winner, General Manager; Pete Moore, Vice Chairman; Bart Mendenhall, Attorney; Wayne Whittaker, Treasurer; Kim Chavez, Financial Coordinator; Melissa Esquibel, Secretary; Randa Morlan, Administrative Assistant; Peter Nichols, Water Attorney; Leroy Mauch, Prowers County Commissioner and Loretta Kennedy.
Visitors to the meeting were welcomed by Singletary, and he requested attendees to introduce themselves and identify the organization, which they represent. Visitors present at the meeting included Wayne Snider, La Junta Development; Virgil Cochran, Southeast Land and Environment; Chris Woodka, Pueblo Chieftain; Brian Taylor, Arkansas Valley Range Project; John Merson, John Martin Reservoir State Park; Harrell and Ollie Ridley, Las Animas; Julie Worley, Rocky Ford GAP; Gilbert Werdel, Larkspur Inc.; Doris Morgan, Senator Allard's office-Pueblo; Brenda Fillmore, AGUA; Bill Yohey, Kiowa County Commissioners office; Kelly Roesch, High Plains A and M and Darlene Scott, OEDIT.
Singletary then introduced Lynden Gill from Bent County and announced that Gill will fill the seat vacated by former Lower Arkansas Valley Water Conservancy District director, Ollie Ridley.
In official district business, the Oath of Office was administered to the newly appointed directors.
In election business, Winner announced that a re-organization meeting of the Lower Arkansas Valley Water Conservancy District Board was needed to elect the Board Officers. Winner heard nominations for the position of Chairman of the Board. Moore nominated Singletary to serve an additional term for the Chairman position, the motion was seconded and Singletary was elected as Chairman.
Winner then opened the floor for nominations for the position of vice-chairman. Whittaker nominated Moore to serve an additional term as the vice-chairman and the motion was approved.
The general manager requested nominations for the secretary position.
Mauch motioned to maintain Esquibel as the secretary for the Lower Arkansas Valley Water Conservancy District Board, with Whittaker also maintaining the treasurer position.
Changes were proposed regarding the office hours for the Water Conservancy District office. Winner suggested a four-day workweek for the district staff including the financial coordinator and the administrative assistant. Winner explained that the office could continue to be open five days per week, with one of the staff members having Mondays off and the other having Fridays off. The staff members would work ten hours per day with the office hours of operation to be from 7:00 a.m. to 5:00 p.m. Following discussion, the change in office hours was approved.
In legal matters, the board approved the change of meeting dates to the third Wednesday of each month. It was further suggested to begin the change of meeting dates as of this month. Approval followed with the motion caring unanimously.
It was then approved for the Lower Arkansas Valley Water Conservancy Board to designate and post the time and place for all board meetings in three different areas, including the Otero County Courthouse, the Water Conservancy office as well as the Rocky Ford City Hall.
The minutes were then approved from the previous meeting of the Lower Arkansas Valley Water Conservancy Board following corrections to the general meeting. The December 14, 2005 Legal Committee Meeting and the Acquisition meeting minutes were also approved with no corrections made.
Singletary noted that in the Acquisition meeting the Board had received a resolution on the Bureau of Reclamation contracts in the January Board packet and that he would like them to review the resolution and express thoughts and opinions to Winner.
In the treasurer's report, Whittaker acknowledged the financial report for December was included in the Board's Monthly Meeting Packet. Whittaker reported that December total revenues were $24,486.30 and the total expenditures were $187,316.75.
Richard Sandquist who is a hydroponics farmer from Vineland, Colorado gave a presentation, giving a speech on the history of hydroponics and discussing the price of investing in a hydroponics farm, the different types of crops that can be grown and which crops would be best for the Arkansas Valley area. Sandquist noted the cost of greenhouses and noted that hydroponics farming uses about 90 percent less water than average farming. Wrapping up the presentation, Sandquist displayed to the Board and visitors heads of lettuce, which he had grown.
Steve Witte who is the Division 2 Water Engineer presented a PowerPoint presentation on Colorado snowpack and the current water supply situation in the state. Witte addressed the status of how the weather is affecting the water supply in Colorado. Witte then gave a precipitation update, also noting that this year's irrigation season "looks good."
It was decided that Kennedy and Winner would meet with Representative McFadyen concerning the water quality bill, currently under consideration.
In legal proceedings, Mendenhall commended the Lower Arkansas Water Conservancy District Board on their patience with the Preferred Storage Option Plan (PSOP) negotiations and Conservation Easements regarding the Pueblo Reservior Expansion Project. Nichols briefly reviewed the PSOP negotiations and what the district plans to achieve from the negotiations. He then commented on the Inter Govermental Agreement (IGA) with the PSOP legislation.
It was then addressed that the Internal Revenue Service (IRS) has come up with new instructions for conservation easements.
According to information provided by the Lower Arkansas Water Conservancy District, the IRS is requiring additional information on the identification of the conservation easement.
The IRS is also requesting clarification on the Fair Market Value (FMV) of the underlying property before and after "the gift," whether "the gift" was to get a permit or other approval from a local government and if the donation was required by a contract.
A description of any interest in nearby property held by the donor or any related party is also of matters of new instruction regarding easements. Furthermore, the instructions require assurance of the donor's resources to monitor and enforce the easement.
Before adjourning, Singletary then briefly commented on the legal filings between Colorado Springs and Aurora and Winner commented on the Arkansas Basin Roundtables meetings, which are held on the second Wednesday of each month.
In other news, the Lower Arkansas Valley Water Conservancy District will sponsor a Drip Irrigation and Water Quality Workshop on March 14th beginning at 9:30 a.m. and running through the day until 3:30 p.m. The workshop will be held at the Gobin Community Center in the Baggage Room which is located at 105 South Main Street in Rocky Ford. Keynote speakers will be Dr. Tim Gates and Dr. Luis Garcia of the Civil Engineering Department, Dr. Mike Bartolo and Dr. Abdel Berreda of the Arkansas Valley Research Center as well as Jim Valliant of the Colorado State University Cooperative all from Colorado State University. Dave Miller of the USDA; Eric Hanagan of Hanagan Farms and Matt Proctor of Proctor Farm will also address the attendees.
There will be no charge for the workshop and lunch will be provided.
The next Lower Arkansas Valley Water Conservancy District Board meeting will be held on Wednesday, March 15th at the district office which is located at 801 Swink Avenue in Rocky Ford. The meeting will begin at 10:00 a.m.
